These Terms and Conditions govern your use of ivfscale.com and include the terms for the IVF Scale SMS Program.
1. About IVF Scale
IVF Scale is a business-to-business marketing consultancy serving IVF practices. Website information is provided for general business purposes and does not constitute medical, legal, or financial advice. IVF Scale does not provide healthcare, diagnosis, or treatment.
2. Website use
Age restriction (18+)
This website and IVF Scale’s services are intended solely for business representatives who are at least 18 years of age and legally capable of entering into binding agreements. By accessing or using this website or submitting a form, you represent and warrant that you are 18 years of age or older and meet these eligibility requirements.
You may use this website only for lawful purposes. You may not interfere with its operation, attempt unauthorized access, introduce malicious code, misuse forms, impersonate another person, submit patient or protected health information, or use website content in a way that violates applicable rights or laws.
3. Consultation requests
Submitting a consultation request does not create a client relationship, guarantee availability, or obligate either party to purchase or provide services. Any services will be governed by a separate written agreement.
4. IVF Scale SMS Program
Program and message types
The IVF Scale SMS Program offers optional recurring text communications to practice representatives who directly provide consent to IVF Scale. Depending on the separate consent category selected, messages may include consultation-request follow-up, scheduling, confirmations, service-related updates, special offers, discounts, and marketing or service announcements.
Enrollment and consent
SMS consent is voluntary, is specific to IVF Scale, and is not a condition of purchasing services, requesting a consultation, or submitting a website form. The website checkboxes are optional and unchecked by default. Consent applies only to the message category selected. Do not provide a telephone number you do not own or control.
Frequency and charges
Message frequency may vary, up to 4 messages per month. Message and data rates may apply for messages sent to you from us and to us from you. If you have questions about your text or data plan, contact your wireless provider.
Opt out and help
After you send STOP, IVF Scale will send an SMS confirming that you have been unsubscribed. After that confirmation, you will no longer receive SMS messages from the applicable program. If you want to join again, submit the website opt-in form and select the applicable optional consent checkbox. We also honor reasonable opt-out requests submitted through other available contact methods as required by applicable law.
Carrier disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Message delivery and availability are subject to carrier networks and other factors outside IVF Scale’s control.
Privacy
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. 5. Intellectual property
The website and its original content, design, branding, and materials are owned by or licensed to IVF Scale and protected by applicable intellectual-property laws. No rights are granted except the limited right to access and use the website under these Terms.
6. Third-party services and links
The website may rely on service providers or link to third-party websites. IVF Scale does not control third-party sites and is not responsible for their independent content, availability, or practices.
7. Disclaimers and limitation of liability
The website is provided on an “as available” basis to the extent permitted by law. IVF Scale does not promise uninterrupted or error-free operation. To the fullest extent permitted by law, IVF Scale will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use. Nothing in these Terms excludes liability that cannot lawfully be excluded.
8. Indemnification and severability
To the extent permitted by law, you agree to be responsible for losses arising from your unlawful misuse of the website or violation of these Terms. If a provision is found unenforceable, the remaining provisions will remain in effect.
9. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction located in Dallas County, Texas, unless applicable law requires otherwise.
10. Changes
We may update these Terms from time to time. Updates become effective when posted with a revised effective date. Continued website use after an update constitutes acceptance of the revised Terms.
